Wife’s Alimony Terminated Due To Her Cohabitation
In the family law, alimony litigation case of Syslo vs. Syslo, 20-2-4363 (App. Div.) The plaintiff appealed the family court order granting the defendant’s motion to terminate alimony due to the wife’s cohabitation with a third party. The panel affirmed, finding satisfactory evidentiary support for the trial court’s credibility determination that plaintiff and the cohabitant were less than credible and finding that there was substantial evidence for the Alimony Terminated that supported the determination of cohabitation, including the extensive number of nights spent by the cohabitant in plaintiff’s home, his possession of a key, his assistance with driving the parties’ unemancipated child, and the fact that in dealing with the IRS the cohabitant provided plaintiff’s home as his address.
