New Jersey Child Support Guidelines Cannot Be Used To Calculate Child Support For College Student Living On Campus
In the child support case of Ferrer v. Reynolds, 20-2-4533, App. Div., the defendant appeals from that part of a Family Part order setting his child support payment at $139 per week, contending that the motion court improperly calculated this amount by using the Child Support Guidelines even though his daughter is a college student living on campus. The panel finds that the trial court erred in using the Guidelines to calculate defendant’s support obligation and remands to the motion court to recalculate child support under N.J.S.A. 2A:34-23(a).
